These Terms of Service explain the conditions that apply when you visit Digital Wizard, place an order, submit project materials, or purchase a digital production service. By accessing this website or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Digital Delivery Policy.
1. About Digital Wizard
The terms “Digital Wizard,” “we,” “us,” and “our” refer to Digital Wizard. We operate this website and provide digital production services that transform raw, scattered, incomplete, or difficult-to-use content into clear, organized, editable, and review-ready files.
Digital Wizard is an independent digital production studio. We do not operate as a general virtual assistant, open-ended consultant, law firm, accounting firm, medical provider, academic institution, or replacement for a licensed specialist.
2. Acceptance and eligibility
By accessing the website, creating an account, submitting project materials, or placing an order, you agree to be bound by these Terms.
You must be at least the age of legal majority in your place of residence and have legal authority to enter into a binding agreement. When purchasing on behalf of a business or other organization, you confirm that you are authorized to bind that organization to these Terms.
You agree to provide accurate, current, and complete account, contact, billing, and project information. You are responsible for protecting your account credentials and for activity conducted through your account.
3. Services and order scope
Each order is governed by:
- the service description displayed at the time of purchase;
- the package and options selected;
- any purchased add-ons;
- the order requirements and materials you submit;
- any written custom quote or written scope confirmation; and
- these Terms and the policies referenced in them.
The service page, selected package, and written order-specific agreement define what is included. Tasks, formats, pages, rows, products, minutes, files, revisions, research, corrections, or deliverables not expressly included are outside the purchased scope.
When an order-specific written agreement conflicts with these general Terms, the order-specific agreement controls only for the subject it expressly addresses.
4. Orders and acceptance
Placing an order is an offer to purchase the selected service. An automated order confirmation does not require us to accept work that is unlawful, unsafe, technically unworkable, materially different from the service description, or outside our production capacity.
We may request clarification or additional files before beginning. We may decline or cancel an order when:
- the requested work falls outside the advertised service;
- the submitted material differs materially from the volume or condition described;
- the material is unlawful, harmful, deceptive, infringing, or unsafe to process;
- the required files or instructions are not provided;
- a technical limitation prevents reasonable completion; or
- continuing the project would violate these Terms or applicable law.
Any cancellation or refund will be handled according to our Refund Policy and applicable law.
5. Customer materials and instructions
“Customer Materials” means any document, spreadsheet, audio, video, transcript, caption file, image, PDF, screenshot, product information, note, link, template, database, instruction, credential, or other content that you provide for the project.
You retain ownership of your Customer Materials. You grant Digital Wizard a limited, non-exclusive license to access, copy, convert, process, edit, organize, store, and transmit those materials only as reasonably necessary to evaluate, produce, deliver, revise, secure, and administer your order.
You represent that:
- you own the Customer Materials or have permission to use and provide them;
- our processing of them will not violate copyright, trademark, privacy, confidentiality, contractual, publicity, or other third-party rights;
- the materials are lawful and do not contain malicious code;
- your instructions are accurate and sufficiently complete; and
- you have obtained any consents required to provide personal information belonging to another person.
You remain responsible for the factual accuracy, legality, permissions, completeness, and intended use of the materials you provide.
Highly sensitive information: Do not submit passwords, full payment card details, private authentication credentials, government access codes, or highly sensitive regulated information unless it is genuinely necessary and Digital Wizard has confirmed in writing that the project can be accepted.
6. Customer cooperation and project timing
Production time begins after:
- payment has been successfully processed;
- all required project materials have been received;
- the materials are accessible and usable; and
- any essential questions have been answered.
Missing files, inaccessible links, unclear instructions, incomplete requirements, unexpected volume, damaged source files, or delayed responses may pause or extend the delivery schedule.
When the actual material differs substantially from what the selected package covers, we may offer an additional charge, revised delivery time, reduced scope, or cancellation under the Refund Policy.
If required information remains unavailable for 30 calendar days, we may close, cancel, or reschedule the project. Charges for work already completed remain subject to the Refund Policy and applicable law.
7. Production tools and AI-assisted processing
Digital Wizard may use software, cloud services, automation, optical character recognition, transcription systems, data-processing tools, and artificial-intelligence-assisted tools as part of its production infrastructure.
These tools support production, organization, conversion, drafting, review, and quality control. Digital Wizard remains responsible for directing the production process and reviewing the deliverable according to the purchased scope.
Customer Materials may be processed through third-party tools only as reasonably necessary to complete or deliver the order. Relevant processing of personal information is addressed in our Privacy Policy.
No automated system is error-free. You are responsible for performing the final review appropriate to your intended use, particularly where the material involves important names, dates, amounts, technical information, regulated matters, or decisions requiring professional judgment.
8. Nature of Deliverables and Final Review
Unless expressly stated otherwise in the purchased service or in a written order-specific agreement, Digital Wizard provides advanced drafts, editable working files, organized bases, structured materials, and review-ready deliverables.
Deliverables are not guaranteed to be definitive, error-free, legally approved, professionally certified, publication-approved, platform-approved, regulatory-compliant, or suitable for every intended use without further review, adjustment, testing, or specialist validation.
A deliverable may be sufficiently complete or prepared for immediate practical use. However, “ready to use,” “upload-ready,” “publication-ready,” “client-ready,” “review-ready,” or similar language describes the level of preparation included in the purchased service. It does not transfer responsibility for final approval, implementation, publication, submission, or use to Digital Wizard.
The customer remains responsible for the final review, approval, decisions, corrections, publication, implementation, uploads, imports, submissions, distribution, and use of all deliverables.
The customer is also responsible for obtaining any legal, accounting, tax, medical, academic, technical, regulatory, editorial, accessibility, compliance, or other specialist review required for the customer’s intended use.
Digital Wizard does not replace the customer’s final decision-making authority, internal approval process, platform review, or the judgment of a qualified specialist.
Before publishing, uploading, importing, submitting, distributing, relying on, or implementing a deliverable, the customer must verify all information that is material to its intended use, including names, dates, figures, prices, formulas, links, product details, technical information, citations, permissions, and platform requirements.
Digital Wizard does not guarantee:
- a perfect, error-free, official, definitive, or universally suitable result;
- legal validity, regulatory compliance, professional certification, or specialist approval;
- acceptance by a school, employer, publisher, marketplace, platform, government agency, court, bank, client, or other third party;
- compatibility with every device, software application, import system, platform, printer, or future software version;
- sales, leads, conversions, rankings, views, clicks, engagement, approval, monetization, or other external results; or
- results that depend on algorithms, third-party decisions, market conditions, customer actions, or circumstances outside Digital Wizard’s control.
SEO-aware or SEO-friendly preparation means that relevant search-oriented structure, phrasing, organization, or suggested keywords may be incorporated into a draft. It does not guarantee rankings, traffic, views, clicks, conversions, or monetization.
Nothing in this section limits any consumer rights, warranties, or remedies that cannot legally be excluded or waived.
9. Revisions and changes
The number of included revisions is shown on the service page or selected package.
A revision means a reasonable adjustment to the delivered work based on the original materials, instructions, and purchased scope. A revision does not include:
- a new project or new direction;
- new source material that changes the original assignment;
- additional pages, rows, products, minutes, files, formats, or deliverables;
- research or fact-checking not originally included;
- rewriting content when only formatting was purchased;
- changes caused by incorrect or incomplete customer instructions; or
- changes requested after the revision period has ended.
Unless the service page or delivery message states otherwise, revision requests must be submitted within 7 calendar days after delivery and should be provided as one clear, consolidated list.
Additional or out-of-scope work may require a separate quote, additional payment, and a new delivery time.
If no revision request is received during the applicable review period, the order may be treated as completed for workflow and file-retention purposes. This does not limit any rights that cannot legally be waived.
10. Digital delivery and file retention
Digital Wizard provides digital services and digital files. No physical product will be shipped unless a product page expressly states otherwise.
Completed files are normally delivered by email to the address used during checkout. The delivery email may contain a private Google Drive link or another secure digital-access method.
You are responsible for:
- providing and maintaining a correct email address;
- checking spam, promotions, and filtered folders;
- opening the delivery link promptly;
- reviewing the delivered files; and
- downloading and securely storing your own copies.
Unless otherwise stated in writing, delivery links will remain available for 30 calendar days from the delivery date. After that period, Digital Wizard may remove project files and cannot guarantee continued access, replacement, restoration, or recovery.
Digital Wizard may retain limited transaction, administrative, security, backup, or legal records where reasonably necessary or required by law. Further information is provided in our Privacy Policy.
11. Prices, payment, and taxes
Prices are displayed in the currency shown at checkout. Unless otherwise stated, Digital Wizard’s principal store prices are displayed in United States dollars.
Payment must be successfully processed before production begins. You confirm that you are authorized to use the payment method submitted with the order.
Prices, packages, promotions, and add-ons may change without notice. Changes do not alter an order that has already been accepted and paid, except where the parties agree in writing to modify its scope.
Applicable taxes may be calculated or collected at checkout depending on the transaction, customer location, payment provider, and applicable law.
Additional work requested after purchase is not included in the original price unless confirmed in writing.
12. Cancellations and refunds
Cancellation and refund requests are governed by our Refund Policy.
Because Digital Wizard provides customized digital services, cancellation eligibility may depend on whether production has begun, how much work has been completed, whether files have already been delivered, and whether the delivered work matches the purchased scope.
Nothing in these Terms removes consumer rights that cannot be excluded under applicable law.
13. Ownership and intellectual property
Customer Materials
You retain your rights in the original materials you provide.
Custom deliverables
After full payment, and subject to any third-party rights or licenses, you may use the custom deliverable created specifically for your order for your personal or business purposes.
To the extent legally transferable, Digital Wizard assigns to you the transferable economic rights in the custom deliverable created specifically for your order. Where a complete assignment is not legally available, Digital Wizard grants you a perpetual, worldwide license to use, reproduce, edit, publish, and distribute that custom deliverable for its intended purpose.
Excluded materials
The transfer or license does not include:
- Digital Wizard’s name, logo, branding, website, service descriptions, or marketing materials;
- pre-existing templates, processes, workflows, methods, prompts, systems, checklists, code, or production tools;
- general skills, concepts, techniques, know-how, or non-customer-specific structures;
- third-party fonts, software, stock assets, templates, plugins, or licensed materials; or
- materials belonging to Shopify or another third party.
Third-party materials remain subject to their own license terms.
Digital Wizard may reuse general methods, workflows, structures, and non-confidential know-how developed during production, but will not publish or reuse your confidential content as another customer’s content.
Digital Wizard will not display your private project files in a public portfolio, case study, or promotional example without your permission.
14. Confidentiality and privacy
Digital Wizard will use Customer Materials for project evaluation, production, delivery, revision, customer support, fraud prevention, legal compliance, and other purposes described in our Privacy Policy.
We will not intentionally publish private Customer Materials or disclose them to unrelated third parties, except:
- to service providers reasonably needed to operate or fulfill the order;
- with your permission;
- to protect rights, safety, systems, or property;
- to investigate fraud, abuse, or prohibited conduct; or
- when required by applicable law or valid legal process.
No internet transmission or storage system can be guaranteed to be completely secure. You should keep your own backups and avoid sending unnecessary sensitive information.
15. Prohibited materials and uses
You may not use the website or Digital Wizard’s services to create, process, distribute, conceal, or facilitate:
- illegal, fraudulent, deceptive, defamatory, threatening, abusive, or malicious material;
- content that infringes intellectual property, privacy, confidentiality, or contractual rights;
- malware, phishing material, stolen credentials, unauthorized access tools, or harmful code;
- forged evidence, false official records, impersonation, or misleading documentation;
- academic work submitted dishonestly as the customer’s own original work;
- unauthorized processing of personal information;
- harassment, exploitation, discrimination, or unlawful surveillance; or
- any activity that violates applicable law, platform rules, or the rights of another person.
We may refuse, suspend, or terminate a project that we reasonably believe violates this section.
You may not scrape, copy, reproduce, reverse engineer, exploit, interfere with, or bypass security or access controls protecting the website or its content.
16. Third-party services
The website and production process may rely on third-party services, including Shopify, payment processors, email providers, cloud-storage providers, file-conversion services, analytics tools, and installed applications.
Your use of those services may also be governed by their own terms and privacy policies. Digital Wizard does not control and is not responsible for changes, outages, restrictions, errors, security incidents, or service interruptions caused by third-party providers, although we will make reasonable efforts to complete or restore delivery when practical.
17. Relationship with Shopify
Digital Wizard is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Digital Wizard.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Digital Wizard, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Digital Wizard, to the fullest extent permitted by applicable law.
18. Website content and feedback
The Digital Wizard website, branding, text, graphics, service descriptions, examples, layouts, and original site content are owned by or licensed to Digital Wizard. They may not be copied, republished, resold, or commercially exploited without written permission.
When you voluntarily publish a review, testimonial, or public comment about Digital Wizard, you grant us permission to reproduce and display that public feedback for legitimate business and promotional purposes, subject to applicable platform rules and law.
This permission does not give Digital Wizard the right to publish your private source files, confidential information, or completed project materials without separate permission.
19. Errors, availability, and events outside our control
We may correct typographical errors, pricing errors, inaccurate descriptions, technical issues, or omissions on the website. When an error materially affects a paid order, we may contact you to confirm a correction, offer an alternative, or cancel and refund the affected portion as appropriate.
Digital Wizard is not responsible for delays or failures caused by events reasonably outside our control, including internet outages, platform failures, cloud-service interruptions, power failures, natural disasters, illness, cyberattacks, government action, payment-processing issues, or failures of customer-provided links, files, or systems.
When such an event occurs, affected deadlines may be reasonably extended.
20. Disclaimer of warranties
To the fullest extent permitted by applicable law, the website is provided on an “as available” basis. Digital Wizard does not guarantee that access to the website will always be uninterrupted, secure, timely, or error-free.
Deliverables are warranted only to materially correspond to the purchased service description, selected package, and agreed written scope. No other warranty is provided except where a warranty cannot legally be excluded.
Nothing in these Terms excludes or limits rights or warranties that cannot be excluded under applicable consumer-protection law.
21. Limitation of liability
To the fullest extent permitted by applicable law, Digital Wizard will not be liable for indirect, incidental, special, punitive, or consequential loss, including lost profits, lost revenue, lost opportunities, loss of goodwill, business interruption, platform rejection, or loss of data resulting from:
- the customer’s use or modification of a deliverable;
- failure to perform an appropriate final review;
- incorrect or incomplete Customer Materials;
- third-party platforms, software, providers, or algorithms;
- customer failure to download or back up files during the retention period; or
- use of a deliverable outside its stated or reasonably intended purpose.
To the fullest extent permitted by law, Digital Wizard’s total liability arising from a particular order will not exceed the amount actually paid to Digital Wizard for that order.
These limitations do not apply where liability cannot legally be excluded or limited.
22. Indemnification
To the extent permitted by applicable law, you agree to indemnify Digital Wizard against third-party claims, losses, and reasonable costs to the extent caused by:
- Customer Materials you did not have the right to provide;
- your unlawful or unauthorized use of a deliverable;
- your violation of these Terms;
- your violation of another person’s rights; or
- false, unlawful, or materially misleading instructions supplied by you.
23. Suspension and termination
We may suspend or terminate access to the website, an account, or an order when we reasonably believe there has been fraud, abuse, nonpayment, prohibited conduct, a security risk, or a material violation of these Terms.
Termination does not affect payment obligations or provisions that by their nature should survive, including provisions concerning intellectual property, confidentiality, liability, indemnification, dispute resolution, and file retention.
24. Governing law and disputes
These Terms and transactions with Digital Wizard are governed by the applicable laws of Mexico, without limiting any mandatory consumer rights that apply in your place of residence.
Before beginning formal legal proceedings, we encourage you to contact Digital Wizard and provide a reasonable opportunity to address the issue informally. This does not prevent either party from exercising any right or remedy available under applicable law.
Except where applicable law requires otherwise, disputes will be submitted to the competent courts in Mexico.
25. Changes to these Terms
We may update these Terms to reflect changes in our services, production methods, technologies, policies, or legal obligations.
The current version will be posted on this page with its effective date. Material changes will apply prospectively unless applicable law requires otherwise.
Terms in effect when an order is placed will ordinarily continue to govern that order unless the parties agree otherwise or a legal requirement applies.
26. Severability, waiver, and entire agreement
If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
A failure to enforce a provision does not waive the right to enforce it later.
These Terms, the policies referenced in them, the applicable service page, the selected package, purchased add-ons, and any written order-specific agreement form the agreement between you and Digital Wizard concerning the order.
